Online Store Regulations

These regulations define the rules of using the Online Store, in particular the conclusion and performance of the sales contract for goods available on the website http://balansis.pl and the rules of return, as well as the complaint procedure.

§ 1 Glossary of terms

1. CompanyBALANSIS COSMETICS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw (address: ul. Mickiewicza 37/58), REGON: 520162088, NIP: 7792531313, entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0000926124.

2. Online Store – an online service belonging to the seller available under the domain http://balansis.pl

3. Customer – a natural person who has completed 13. years of age, however, if the person is under 18, the consent of their legal representative is required, unless they have full legal capacity, as well as a legal person or an organizational unit without legal personality, to which the law grants legal capacity, which uses the Online Store, in particular, which places an order via the Online Store under the terms and conditions set out in these Regulations.

4. Consumer – a Customer who is a natural person who performs a legal act with BALANSIS COSMETICS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ   not directly related to their business or professional activity, in particular, which places an order in the Online Store.

5. Entrepreneur with Consumer Rights – means a natural person concluding a Sales Agreement directly related to their business activity, when the content of the Sales Agreement indicates that it does not have a professional character for this Entrepreneur, resulting in particular from the subject of the business activity performed by them, made available on the basis of the provisions on the Central Register and Information on Business Activity.

7. Goods – an item available for sale in the Online Store.

8. Registration – a one-time action consisting in the creation of an account by the Customer, made using the administrative panel made available by the Seller on the Store’s website.

9. Order processing time – the number of business days in which the order is completed, entrusted to the carrier and delivered via the carrier to the place indicated by the Customer.

10. Working days – weekdays from Monday to Friday, excluding public holidays.

11. Order – a declaration of will by the Customer, submitted via the Online Store, specifying: the type and quantity of goods in the assortment of the Online Store at the time of placing the order, the method of payment, the method of delivery of the goods, the place of issue of the goods and the Customer’s data, constituting the submission by the Customer of an offer to conclude a sales agreement via the Online Store for the goods that are the subject of the order.

§ 2 General Provisions

1. The owner of the Online Store is BALANSIS COSMETICS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw at ul. Mickiewicza 37/58, entered into the register of entrepreneurs of the National Court Register under the KRS number: 0000926124, maintained by the District Court for Gdańsk-Północ in Gdańsk, 8th Commercial Division of the National Court Register, with the NIP: 5862347684 and REGON: 384113264.

2. To use the Store Internet, browsing the available assortment and concluding a sales agreement, it is necessary to have:

a) devices allowing access to the Internet,

b) an Internet browser in order to download and display the website,

c) an active e-mail account.

3. Costs resulting from the use of the Internet by the Customer are borne personally by him.

4. The Seller may communicate with the Customer via e-mail [email protected].

5. The Customer may communicate with the Seller via e-mail or the contact form available on the website.

6. In order to ensure the security of messages and data transmitted in the Online Store, technical and organizational measures are taken appropriate to the level of risk, in particular measures to prevent access and modification by unauthorized persons, data sent via the Internet. Correspondence is subject to antivirus protection and is addressed only to a specific Customer.

7. The subject of sale are brand new goods, free from defects, presented by the Online Store at the time of placing the order by the Customer.

8. The prices of goods presented on the websites of the Online Store are expressed in Polish zlotys and are gross prices, i.e. they include taxes, including value added tax (VAT).

9. The phlov.com Online Store conducts retail sales only. Orders may be placed only by entities that are consumers within the meaning of art. 22, item 1. of the Civil Code. The Online Store does not conduct sales to actively registered business entities. The Seller may not conclude a sales agreement with the Customer if, during verification, it turns out that the subject of the business activity conducted by the Entrepreneur with the rights of the Consumer is contrary to the essence of the retail sale of the balansis.pl Online Store.

10. The prices of goods given on the websites of the Online Store do not include the costs of delivering the goods. The costs of delivering the ordered goods are always provided on the website of the Online Store during the order placement, including immediately before and at the time of confirmation and placement of the order by the Customer, and are included in the total value of the order. The total value of the order includes the price of the goods and the costs of their delivery.

11. Information on the price of the goods, features and essential properties of the goods are available on the website of the Online Store and are placed with the presented goods.

12. The binding and final price is the price given in the “Basket” in the order summary at the time of placing the order by the Customer via the Online Store.

13. The prices of goods given on the websites of the Online Store are valid only when placing orders via the Online Store.

14. The prices of goods presented on the websites of the Online Store may change, but the change in the price of the goods does not affect orders placed before the price change comes into effect.

15. A limited number of Goods are intended for permanent, promotional and clearance sales. Orders are fulfilled in the order in which they are received, until the stocks covered by this form of sale are exhausted.

16. The Customer using the Online Store is obliged to:

a) use the Online Store in a manner consistent with applicable legal regulations and the provisions of these Regulations,

b) use the Online Store in accordance with good practices and with respect for the personal rights of other entities,

c) not provide or transfer content of an illegal nature,

d) use the Online Store in a manner that does not disrupt its functioning,

e) use any content posted on the Online Store only for personal use,

f) not take actions involving the sending or placing of unsolicited commercial information (spam) on the Online Store.

17. The Seller is not responsible for incorrectly entered data by the Customer that may hinder the fulfillment of the order. Providing false data may be subject to criminal liability.

§ 3 Registration and Login

1. In order to enable full use of all functionalities of the Store, the Customer may register.

2. Creation and use of the Customer Account on the Online Store Website is provided electronically

3. Registration is one-time, voluntary, free of charge and is not necessary to place Orders in the Online Store

4. The Customer may register the Customer Account in the Online Store after clicking the “Log in/Register” tab on the main page of the Online Store or may register the Customer Account when placing an order via the Online Store.

5. The Customer may register the Customer Account by connecting an already registered account on the Facebook social networking site or through an existing Google account.

6. Registering the Customer Account in the Online Store requires filling out the registration form by providing an e-mail address and password. In order to register a Customer Account, the Customer must read and accept these Regulations, as well as express consent to the processing of their personal data provided during registration, marked as mandatory. Providing data marked as mandatory is necessary to set up a Customer Account, fulfill and service orders placed in the Online Store, as well as properly perform services provided electronically.
